These Terms of Service ("Terms") govern your use of the Pale mobile application (the "Service") operated by MigraTeck LLC ("we", "us", "our"). By using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use the Service. By creating an account, you represent that you meet this age requirement and that the information you provide is accurate.

2. Account Registration

To use Pale, you must register with a valid phone number. You are responsible for maintaining the security of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Send spam, unsolicited messages, or bulk communications
• Harass, threaten, or intimidate other users
• Impersonate any person or entity
• Upload or transmit malware, viruses, or harmful code
• Attempt to gain unauthorized access to the Service or other users' accounts
• Use the Service to distribute illegal content
• Violate any applicable laws or regulations

4. User Content

You retain ownership of the messages, voice notes, images, videos, and files you send through the Service ("User Content"). By using the Service, you grant us a limited license to transmit, store, and deliver your User Content to intended recipients.

You are solely responsible for your User Content and the consequences of sharing it.

5. SMS Communications

By registering, you consent to receive SMS messages from us for account verification (OTP codes). Message frequency varies. Message and data rates may apply. Reply STOP to opt out. Reply HELP for assistance.

6. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

7. Intellectual Property

The Service, including its design, logo, name, and underlying technology, is the property of MigraTeck LLC and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

8. Termination

We may suspend or terminate your account at any time if you violate these Terms or engage in conduct that is harmful to other users or the Service. You may delete your account at any time through the app settings.

9. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, MigraTeck LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify and hold harmless MigraTeck LLC and its officers, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page. Continued use of the Service after changes constitutes acceptance of the updated Terms.
